Introduction

Russian Federation is a Relevant non Contracting Party of the GFCM. The country is party to the UN Law of the Sea Convention (12 March 1997) and to the UN Fish Stock Agreement of 1995 (4 August 1997). Russian Federation has not ratified the FAO Compliance Agreement of 1993, and also the FAO Port State Measures Agreement of 2009.

FISHERIES

Access regime to fisheries resources

Paragraph 1 of the Article 16 of the Federal Law No. 166-FZ on Fisheries and Conservation of Aquatic Biological Resources determines the different types of fishing existing in the Russian Federation, namely:
1) industrial fishing;
2) coastal fishing;
3) fishing for scientific research and control purposes;
4) fishing for educational and cultural purposes;
5) fisheries for aquaculture (fish farming);
6) amateur and sport fishing;
7) fishing in order to ensure the maintenance of the traditional way of life and the traditional economic activities of small-in-number indigenous peoples of the North, Siberia and Far East of the Russian Federation.
Paragraph 4 of the Article 16 of the Federal Law No. 166-FZ on Fisheries and Conservation of Aquatic Biological Resources prohibits an entrepreneurial activity for foreign persons and registered in the Russian Federation persons from vessels belonging to foreign persons, unless otherwise provided by this Federal Law and other federal laws.


Administrative authorizations and licenses

Paragraph 1 of the Article 34 of the Federal Law No. 166-FZ on Fisheries and Conservation of Aquatic Biological Resources states that the permit for the catch of aquatic bioresources can be issued when exercising: 1) industrial fishing;
2) coastal fishing;
3) fishing for scientific research and control purposes;
4) fisheries for educational and cultural-educational purposes;
5) fisheries for aquaculture (fish farming);
6) organization of amateur and sport fishing;
7) other cases provided by this Federal Law.
Paragraph 4 of the Article 34 of the Federal Law No. 166-FZ on Fisheries and Conservation of Aquatic Biological Resources stresses that the permit for the catch of aquatic bioresources shall be issued in respect of each vessel engaged in fishing.

Conservation and control measures

Restrictions apply on fisheries resources

Fish and other aquatic organisms are protected from threats by Order of the Ministry of Agriculture of Russia of 01.08.2013 No. 293 "On the Approval of Fishing Rules for the Azov-Black Sea Fisheries Basin".

Observers
Vessel Monitoring System

There is the establishment and activities of the Federal Government-Financed Institution "Centre Of Fishery Monitoring (System) and Communications" (hereinafter – system), which has been established for the following purposes:
1) Increasing the efficiency of the interdepartmental cooperation;
2) Reduction the time of service delivery;
3) Simplification the submission of applications;
4) Remote centralized access for entities and citizens to the information about services;
5) Providing economic security of the Russian Federation.
This system:
1) Comprises collection and analysis of data of production activities and location of Russian-controlled and foreign vessels;
2) Processes statistical and real-time data of production activities of ship-owning companies;
3) Maintains a database and data bank by satellite positioning systems and controls activities of Russian-controlled and foreign vessels;
4) Increases efficiency of researches of water bioresources stocks and its habitat for precise quota without prejudice to the environment.
This system allows to collect real-time data and helps supervisory authorities efficiently deter the unlawful fisheries. Thanks to this system, for the past 10 years the fishing industry has managed to increase the yield of codfish, pollock, sardines, crabs and shrimps.
This system also stimulates growth rates of exploration of new areas of yield of bioresources
